New Garden Rezoning Battle is Brewing

Have you heard about the rezoning storm that is brewing over on New Garden Road?  Here is what Friends of New Garden Road Web site says about the situation,

“Friends of New Garden Road is a group of neighborhood residents opposed to the rezoning of 4.69 acres at 1807 and 1809 New Garden Road between Timberoak/Strathmore and Jefferson/Will Doskey to commercial to allow the construction of an “Event Center for weddings and similar parties.”

We think this is a really bad idea, and we are encouraging residents of our neighborhood who agree with us to speak out and let our elected officials know that we value the quality of our community and insist on maintaining it.”

The Web site continues to state that council will hear the rezoning request on September 16.  The case was postponed on “August 4th because Derek “conflict of interest”Allen from Brooks Pierce Law Firm came up at the last minute to get a continuance on this rezoning case. The neighbors were none too happy to see this lawyer in question come up at last minute to have the continuance. It made for a few brief discussions and also a directive from the Greensboro City Council to come up with better communications with surrounding owners on rezoning continuance request.”  My mistake, this quote was from TriadWatch.  I was doing to much at once when I wrote this.

ryan don’t quote from my own blog triadwatch and make it out to be a part of friends of new garden. That is triadwatch point of view not the friends of new garden . Please correct

The Board of Adjustment is a quasi-judicial board made up of seven members and two alternates. The only appeal of a decision of the board is to the North Carolina Superior Court. Five board members were present at the meeting. The chairman, John Cross, also of Brooks Pierce law firm, so he has to recuse himself from any issues involving Allen. Scott Brewington, who is another Board of Adjustment member, had to recuse himself because his wife is in Brooks Pierce with Allen and Cross. No matter how many members are present, it takes four votes on the Board of Adjustment to make a decision, so the matter was automatically continued.

Then why did you not also list that John “conflict of interest” Cross and Scott “conflict of interest” Brewington in your statement? Just going for accuracy in negative statements.

Also, did Derek actually have a conflict in the rezoning case?

I tracked down the article in question and everything is not always as you read. John stated that the BOA has a dim view of members not in attendance making it seem like a relaxed board. In reality we typically have seven individuals present. Prior to our meeting as I was talking to John Hammer, Chairman of the Board, John Cross spoke up and stated that we typically have a great turnout amongst members, and at times even have two alternates present. I just wanted to clarify that.
